Welcome to Awestruck (“we,” “us”). By using our website or app (“Service”), you agree to these Terms & Conditions.

1. Definitions

  • User/You: anyone browsing, booking, or listing experiences.
  • Experience Partner: a third-party provider offering activities through Awestruck.
  • Experience: Short experiences (workshop, tour, event, etc.) bookable via the Service.

2. Service Description

Awestruck provides discovery, booking, payment processing, and support for hyper local experiences. We act as a facilitator of local experiences and do not act like the actual experience provider.

3. User Obligations

  • You must be 18+ and able to enter binding contracts.
  • You agree to provide accurate personal, payment, and contact information.
  • You will honor all bookings you confirm; failure to attend or pay may result in account suspension.

4. Booking & Payment

Bookings are confirmed only after full payment except wherever it is mentioned “Book in Advance”. For cancellations and refund please visit our Cancellation policy page.

5. Experience Partners’ Policies

Each Experience has its own rules: price, cut-off times, and age/health restrictions. You must review the “Terms” link on each Experience page before booking.

6. Disclaimers & Liability

  • We vet partners via ratings, reviews, and background checks, but YOU must do your own due diligence before booking.
  • Awestruck is not responsible for physical or property damage arising from an Experience.
  • To the fullest extent permitted by law, our liability is limited to the booking fee you paid.

7. Intellectual Property

All content, trademarks, and software are owned by Awestruck or its licensors. You may not reproduce or use them outside the Service.

8. Modifications & Termination

We may update these Terms at any time (posted with a new date). Continued use constitutes acceptance. We may suspend or terminate accounts for violations.

9. Governing Law

These Terms are governed by Indian law and subject to Mumbai courts’ jurisdiction.

Privacy Policy

Awestruck (“we,” “us”) respects your privacy. This Policy explains what we collect, why, and how you control it.

1. Information We Collect

  • Personal Data: name, email, phone, payment details
  • Booking Data: selected Experiences, dates, locations, partners
  • Device & Usage Data: IP, browser, app interactions, cookies
  • Preference Data: ratings, favorites, feedback

2. How We Use Your Data

  • Service Delivery: confirm bookings, process payments, send reminders
  • Personalization & AI Training: to learn your mood, timing, and style, improving future recommendations
  • Analytics & Improvement: measure performance, detect fraud, optimize UX
  • Marketing & Communication: share promotions, updates, surveys (you may opt out)

3. Data Sharing

  • Experience Partners: share booking details to fulfill your Experience
  • Service Providers: payment processors, cloud hosts, support tools
  • Legal Compliance: disclose if required by law or to protect rights

4. Cookies & Tracking

We use cookies and similar tech to personalize content, remember settings, and measure traffic. You can disable cookies in your browser but some features may break.

5. Data Retention & Security

  • We retain personal data as long as needed for service and legal obligations.
  • We implement industry-standard encryption and access controls.

6. Your Rights

  • Access & Correction: request your data or ask us to update it.
  • Deletion:ask us to delete your account and personal data (subject to legal holds).
  • Objection: you may object to processing for marketing.

7. Children’s Privacy

Our Service is not for children under 18. We do not knowingly collect their data.

Cancellation Policy

A. Overview

Cancellation policies vary by Experience Partner. Always click the “Cancellation” tab on an Experience pop-up/page before booking.

B. Free Cancellation Window

Within 5 minutes of booking: full refund to your awestruck wallet. If you need it to your bank account, please follow the process mentioned in your dashboard.

C. Partner-Defined Cut-Off

After 5 minutes, you may cancel according to the cut-off time and fees set by the Experience Partner (e.g. 24 hrs before, 50% refund).

D. Refunds

Refunds (if any) will be processed to your original payment method within 7 business days.

E. No-Show & Late Cancellations

No-shows and cancellations past the cut-off incur 100% charge.

F. Force Majeure

If an Experience is canceled by the partner due to weather, safety, or government restrictions, you’ll receive a full refund or credit.

G. Disclaimer
